Terms of service

1. These terms
These terms are an agreement between you and Mindym (“Mindym”, “we”, “us”) for using the Mindym website, web app and mobile apps (the “Service”). By using the Service you agree to them. If you don’t agree, please don’t use Mindym.
2. Who can use Mindym
You must be at least 13 years old. If you’re under 18 (or the age of majority where you live), you need permission from a parent or guardian, who also agrees to these terms.
3. Your account
You can play as a guest. Guest progress is tied to the browser or device you play on and may be lost if you clear its data; save your progress with Google or email to keep it. You’re responsible for activity on your account. Choose a display name and username that aren’t offensive, misleading or someone else’s; we may change or remove names that break these terms.
4. Not medical advice
Mindym is for entertainment and personal insight. It is not a medical device and does not diagnose, treat, cure or prevent any disease or condition. Scores are estimates from short games and can vary for many reasons. Don’t use Mindym to make health decisions; if you’re concerned about your memory or thinking, please see a doctor.
5. Premium, trials and payments
- Free trials. New players and some invites receive free Premium days. Trials need no payment details and simply end; they don’t turn into a paid subscription on their own.
- Subscriptions (when available) are billed through the Apple App Store, Google Play, or Stripe on the web, at the price shown before you buy. They renew automatically for the same period until you cancel.
- Cancelling. Cancel at any time in your App Store or Google Play subscription settings, or through the link in your Stripe receipt. You keep Premium until the end of the period you’ve paid for.
- Refunds follow the rules of the store you paid through. For web purchases, email us within 14 days if something went wrong and we’ll make it right.
- Price changes are announced in advance and apply from your next renewal; you can cancel before then.
6. Fair play
Please don’t:
- use bots, scripts or other tools to play, submit results, or create accounts;
- try to get around our systems, access other players’ data, or disrupt the Service;
- copy, resell or reverse engineer the Service, except where the law allows;
- harass other players or use Mindym to send spam.
We may remove results that weren’t played fairly, and suspend or close accounts that break these terms.
7. Our content
Mindym, its games, puzzles, designs, text and software belong to us or our licensors and are protected by law. We give you a personal, non-transferable licence to use the Service for your own, non-commercial enjoyment. You’re welcome to share screenshots and challenge links.
8. Your content
You keep ownership of what you add, such as your display name. You give us permission to store and show it as needed to run the Service, for example showing your name to your friends.
9. Changes and availability
We’re always improving Mindym, so features may change, and we may add, change or retire games or puzzles. We try to keep the Service available but can’t promise it will always be uninterrupted or error-free.
10. Ending your use
You can stop using Mindym and delete your account at any time (Profile → Delete account). We may suspend or end your access if you break these terms or if we stop offering the Service; if we stop offering a paid subscription, we’ll refund the unused part where the law requires.
11. Disclaimers
The Service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. Some places don’t allow these exclusions, so some may not apply to you.
12. Limitation of liability
To the fullest extent the law allows, we aren’t liable for indirect, incidental, special or consequential damages, or loss of data or profits, arising from your use of Mindym. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim, or US $50. Nothing in these terms limits liability that can’t be limited by law, or your rights as a consumer.
13. Governing law
These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. If you’re a consumer, you also keep the protection of the mandatory laws of the place you live.
14. Changes to these terms
We may update these terms. For important changes we’ll tell you in the app or on this page before they take effect. If you keep using Mindym after that, the new terms apply.
